This statement explains the policy of the FPS Mobility and Transport on the processing of personal data and implements the transparency obligations contained in the General Data Protection Regulation (hereinafter referred to as “GDPR”).
This statement is subject to change as a result of changes to our processing procedures, new regulations, and the evolution of the stance of the supervisory authorities. The FPS Mobility and Transport always endeavours to take these developments into account in an appropriate and timely manner within the framework of this statement and, if necessary, to provide you with additional information.

The data controller, on its own or with others, determines the purpose and means of the processing of such personal data. As in any large organisation, the various departments of the FPS Mobility and Transport are entrusted with specific processing operations of personal data for organisational and/or regulatory reasons.

The DPO ensures compliance with the regulatory framework for data protection and is the contact person for all matters relating to the processing of personal data and the exercise of your rights under the GDPR.
The FPS Mobility and Transport has an extremely wide range of tasks. Its departments process different categories of personal data for a wide variety of purposes. However, we would like to give you a brief overview of the main grounds for processing, categories of personal data processed, and purposes of processing:

Personal data will never be processed by the FPS Mobility and Transport for advertising purposes, nor transmitted to third parties who would use personal data for such purposes.
The FPS Mobility and Transport only retains personal data for the time required for its intended processing. Retention periods are always determined according to the purpose of the processing. In this respect, account is taken of the periods set out in the regulations governing the relevant processing, the principles set out in Article 5 of the GDPR, and the obligations imposed on the FPS Mobility and Transport by the regulations on archives (essentially the Archives Act of 24 June 1955).
Personal data are shared with third parties when the FPS Mobility and Transport is required to do so based on its legal obligations, as part of the performance of a task carried out in the public interest or in the exercise of official authority, because of a legitimate interest or after having obtained your consent. These third parties may be actors from the public sector (e.g. the FPS Justice) or the private sector (e.g. producers of authentication documents).
In compliance with Belgium's international obligations and in accordance with the regulations in force, the FPS Mobility and Transport may be required to disclose personal data to a third country or an international organisation (e.g. foreign police services).
Depending on the processing of personal data, the data subject has a number of rights in relation to their data. These rights are as follows:
the right of access and to obtain a copy;
the right to rectification;
the right to object;
the right to restriction of processing;
the right to erasure;
the right to data portability;
the right to withdraw consent.

Right of access and to obtain a copy: you have the right to consult your personal data processed by the FPS Mobility and Transport and to obtain a copy free of charge.
Right to rectification: you have the right to have incorrect personal data concerning you rectified as quickly as possible. In view of the purposes of the processing, you have the right to have any incomplete personal data completed.
Right to object: in a number of cases, you may at any time object to the processing of your personal data for grounds relating to your specific situation.
Right to restriction of processing: in a number of cases, you have the right to obtain a restriction of processing of your personal data.
Right to erasure: in a number of cases, you have the right to have your personal data erased without undue delay.
Right to data portability: in a number of cases, you have the right to receive your personal data, which you have provided to the FPS Mobility and Transport, in a structured, commonly used and machine-readable format, and the right to transmit those data to another data controller, without hindrance from the FPS Mobility and Transport.
Right to withdraw consent: for the processing of personal data carried out on the basis of your consent, you have the right to withdraw this consent.
